These terms and conditions govern the relationship between Journeys by Jacqy (“we/us/our”) and you, the purchaser or traveler (“Client”, “passenger”, and “you/your”). By planning travel with Journeys by Jacqy, you agree to be bound by these terms and acknowledge that Journeys by Jacqy acts solely as a booking agent for disclosed principal supplier tour operators, cruise lines, hotels, airlines, air charters, bus companies, ground transportation, boat purveyors or owners, and other independent contractors providing accommodations, transportation, and other services (“Supplier(s)”) and is not the source or provider of the travel services. These terms include warranties, disclaimers, and exclusions of liability, and may restrict your rights and remedies while providing protection to Journeys by Jacqy.

1. Use of Services, Access, and Information for Travel Bookings

 

• Authority & Accuracy: You warrant that you are at least 18 years of age and possess the legal authority to enter into this Agreement and to make travel bookings with Journeys by Jacqy. You agree to be financially responsible for all travel bookings made with us, whether on behalf of yourself or others in your traveling party. All information supplied by you on behalf of yourself, household members, or others for whom you are authorized to transact business must be true and accurate.
   

• Legitimate Bookings Only: You agree to make only legitimate reservations or purchases with Journeys by Jacqy and its Suppliers. Speculative, false, or fraudulent reservations are strictly prohibited.

• Supplier Terms: Journeys by Jacqy accepts all bookings solely as a booking agent for travel Suppliers. Separate Supplier terms and conditions apply to your reservation and purchase of travel-related goods and services. By booking travel through Journeys by Jacqy, you agree to comply with the purchasing terms imposed by each selected Supplier.

• Independent Arrangements: Journeys by Jacqy is not liable or responsible for arrangements made independently of our agency. We assume no responsibility for costs or fees incurred for independent arrangements, including airline, hotel, excursion, and travel protection charges. If you arrange your own airfare, Journeys by Jacqy is not responsible for losses resulting from schedule changes, delays, or cancellations, and cannot assist with self-booked air reservations.
   

• Loyalty Programs: Frequent flyer miles, hotel rewards, or loyalty points may not be redeemable or earnable for travel arrangements made through Journeys by Jacqy.
  ​

• Seller of Travel Registrations: Journeys by Jacqy is an Independent Contractor of Outside Agents, California Seller of Travel 2090937-50 (Registered Affiliate), Florida ST15578, Washington 603189022. Registration as a seller of travel does not constitute approval by the State of California.

2. Right to Correct Errors and Offers Subject to Availability

We reserve the right to correct errors. In the event of a pricing error or omission, we reserve the right to adjust pricing or make necessary corrections. All offers, incentives, and Supplier promotions are subject to availability and may change without notice. You are advised to confirm reservations well in advance of anticipated travel dates to prevent rate increases, loss of availability, or late booking fees.

3. Payments, Cancellations, and Changes to Bookings

​

• Financial Responsibility: You are completely responsible for all charges, fees, duties, taxes, and assessments arising out of your travel bookings through Journeys by Jacqy. Submitting a credit card authorization form permits Journeys by Jacqy to use your payment method to purchase travel products from Suppliers on your behalf.
   

• Chargeback Restrictions: EXCEPT IN CASES OF FRAUD, YOU AGREE NOT TO FILE ANY DISPUTE WITH YOUR BANK OR CREDIT CARD COMPANY TO AVOID OR VIOLATE BOOKING TERMS OF JOURNEYS BY JACQY OR ITS SUPPLIERS. IF YOU ATTEMPT TO CHARGEBACK, REVERSE, OR RECOLLECT A PREVIOUSLY AUTHORIZED PAYMENT, JOURNEYS BY JACQY RESERVES THE RIGHT TO COLLECT ALL ASSOCIATED COSTS, FEES, AND EXPENSES, INCLUDING ATTORNEY FEES.​
   

• Payment Schedules & Cancellations: Payments are due prior to departure according to each Supplier’s terms. Failure to make final payment or violation of Supplier terms may result in cancellation of reservations, denied boarding/access, or forfeiture of monies paid. Some bookings are non-refundable once under deposit. All cancellation requests must be sent to Journeys by Jacqy in writing. Cancellation penalties imposed by Suppliers or Journeys by Jacqy may apply and will be charged to your authorized payment method or deducted from any Supplier refund.

• Changes to Itineraries: Requests to modify confirmed arrangements must be made in writing. You are responsible for any cost increases, as well as change fees imposed by Suppliers or Journeys by Jacqy. Unused portions of travel based on contract rates are non-refundable.

4. Travel Documents, TSA, DHS, REAL ID, and Identification Requirements

​

• Passports & Identification: Clients are responsible for obtaining and carrying a valid passport book, visas, and all required government documents. Passport cards are generally not accepted for international air travel. Domestic U.S. travel requires compliance with REAL ID regulations enforced by the TSA and DHS. • Passport Validity & Visas: Many countries require passports to be valid for at least six (6) months beyond your planned return date. Non-U.S. citizens must inform Journeys by Jacqy prior to booking. Journeys by Jacqy does not issue or guarantee visa approvals and is not responsible for financial losses if a visa is denied.​
   

• Minors: Minors traveling with one parent or without parents may require notarized consent documentation. Visit cbp.gov for guidelines.​
   

• Name Matching: The name, date of birth, and gender on your government identification must exactly match your travel tickets and reservations. Discrepancies may result in denied boarding or significant delays.
  ​

• Verification Responsibility: UPON RECEIPT OF TRAVEL DOCUMENTS, YOU MUST REVIEW AND VERIFY ALL INFORMATION FOR ACCURACY AND NOTIFY JOURNEYS BY JACQY IMMEDIATELY OF ANY DISCREPANCIES. IF YOU DO NOT NOTIFY US OF CORRECTIONS WITHIN TWENTY-FOUR (24) HOURS OF RECEIPT, JOURNEYS BY JACQY BEARS NO RESPONSIBILITY FOR COSTS ASSOCIATED WITH MAKING CORRECTIONS.

5. Individual Entry and Exit Requirements

​

Individual countries set entry policies regarding past criminal records. If you have a prior criminal offense (including DWI or unpaid child support judgments), contact the destination country directly regarding entry requirements. Journeys by Jacqy does not inquire into clients' criminal histories out of respect for privacy. Refer to the U.S. State Department (travel.state.gov) or destination government websites (e.g., canada.ca) for guidance.

6. Immunizations and Health Screenings

​

Clients must possess required immunizations, health screenings, and official documentation prior to travel. Journeys by Jacqy assumes no responsibility for verifying health or entry documentation requirements. Consult your health practitioner before booking regarding vaccinations or medications. For official health and travel notices, consult travel.state.gov and the CDC at cdc.gov/travel.

7. Risks and Safety

​​

• Destination Safety: Journeys by Jacqy encourages clients to review travel advisories and news updates prior to booking. Information on safety, health, and travel risks can be reviewed at state.gov, tsa.gov, dot.gov, faa.gov, cdc.gov, and cbp.gov. We recommend registering with the Smart Traveler Enrollment Program at step.state.gov.
   

• Assumption of Risk: JOURNEYS BY JACQY DOES NOT WARRANT THAT TRAVEL TO ANY DESTINATION IS RISK-FREE OR ADVISABLE AND IS NOT LIABLE FOR LOSSES RESULTING FROM TRAVEL TO SUCH LOCATIONS.
  ​

• Physical Activity & Medical Fitness: Certain activities involve inherent risks, remote locations, changing weather, or physical exertion that may aggravate pre-existing conditions. Seek medical advice if unsure of your physical ability. You must follow all safety instructions and wear recommended protective gear.​
   

• Substance Use: IF YOU ARE UNDER THE INFLUENCE OF ALCOHOL OR DRUGS DURING ACTIVITIES, YOU ASSUME ALL RISKS OF INJURY OR PROPERTY DAMAGE AND AGREE TO INDEMNIFY JOURNEYS BY JACQY FROM ANY RESULTING LIABILITIES.
  ​

• Emergency Alterations: Journeys by Jacqy reserves sole discretion to alter itineraries or cancel escorted departures in emergency health or safety situations.

8. Air Travel, Schedule Changes, and Check-In

​​

• Airline Contracts: Your airline ticket is a contract between you and the air carrier. Journeys by Jacqy is not liable for airline operations, delays, cancellations, schedule changes, baggage fees, fuel surcharges, or airline insolvency.
   

• Ticketing Rules: Failure to use a flight segment may result in automatic cancellation of remaining flights without a refund. Certain departure taxes must be paid in cash upon departure in select countries.
  ​

• Frequent Flyer & Seating: Accrual of miles, point redemptions, and class upgrades are governed solely by the airlines. Seat assignments are not guaranteed and may incur additional airline fees.

9. Limitations of Responsibility and Disclosure

​

• Agent Capacity: Journeys by Jacqy acts strictly as a booking agent for independent principal Suppliers. We do not own, control, or operate these independent entities.​​
   

• Group Requirements & Itinerary Modifications: Group tours dependent on minimum participant numbers may be subject to surcharges or cancellation if capacity is not met. Suppliers reserve the right to modify itineraries due to weather or operational needs.
   

• Limitation of Liability: JOURNEYS BY JACQY DISCLAIMS ALL LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE, DELAYS, OR LOSS CAUSED BY THE ACTS, OMISSIONS, CANCELLATIONS, BANKRUPTCIES, OR FAILURE OF SUPPLIERS TO DELIVER SERVICES.
   

• Maximum Recovery: RECOVERY FROM JOURNEYS BY JACQY FOR ANY CLAIM SHALL BE LIMITED STRICTLY TO THE AMOUNT OF COMMISSIONS AND FEES ACTUALLY RECEIVED BY JOURNEYS BY JACQY FOR YOUR BOOKING.​​

10. Force Majeure

​

Journeys by Jacqy is not liable for non-performance, delays, or failures caused by events beyond its reasonable control, including acts of God, war, terrorism, epidemics, pandemics, quarantines, natural disasters, governmental actions, strikes, equipment failures, or severe weather.

​

• Supplier Force Majeure: Suppliers maintain their own force majeure policies and may cancel or modify trips at their discretion. Refunds for force majeure events are subject to the Supplier's policies, though Journeys by Jacqy will make reasonable efforts to assist in recovering funds where eligible.
   

• Insurance Notice: THE PURCHASE OF COMPREHENSIVE TRAVEL INSURANCE IS STRONGLY RECOMMENDED FOR ALL TRIPS.

11. Client Conduct

​

• Behavioral Expectations: Travelers on escorted or individual trips must act responsibly and follow dress codes and behavioral guidelines established by Suppliers and local authorities. Journeys by Jacqy and Suppliers reserve the right to remove any passenger whose conduct endangers or disrupts others. No refunds will be provided in such cases.​
   

• Damage & Illegal Substances: You are responsible for any physical damage or loss caused at accommodations or transport facilities and must compensate the Supplier directly. Possession or use of illegal drugs will result in immediate termination of travel services. You are responsible for observing local laws regarding prescription medications.

12. Travel Insurance

​

JOURNEYS BY JACQY OFFERS ACCESS TO THIRD-PARTY TRAVEL INSURANCE. UNLESS EXPLICITLY STATED, TRAVEL INSURANCE IS NOT INCLUDED IN YOUR ITINERARY COST. PROTECT YOU FROM FINANCIAL LOSS IN ALMOST ALL CIRCUMSTANCES.

 

Proper travel insurance may protect against supplier default, trip cancellation, delays, medical emergencies, evacuation, lost luggage, and unexpected changes. If you decline insurance, Journeys by Jacqy may require you to execute a written waiver. Journeys by Jacqy is not a licensed insurance agency; advisors cannot evaluate existing coverage or answer technical policy questions. We cannot guarantee claim approvals by insurance providers.

13. Termination

​

We reserve the right to suspend or terminate your access to our services immediately and without notice if we reasonably believe you have violated these Terms. We reserve the right to discontinue any portion of our services at any time without liability.

14. Reservation of Rights and Changes to Terms

​

We reserve the right to modify these Terms and Conditions at any time. Updated versions will be posted on our website and provided to clients, taking effect immediately upon posting.

15. General Provisions

​

• Governing Law & Jurisdiction: These Terms are governed by the laws of the State of Texas. You consent to the exclusive jurisdiction and venue of courts located in Harris County, Texas for all disputes.
   

• Statute of Limitations: Any claim against Journeys by Jacqy must be filed within twelve (12) months following the completion date of the trip.
   

• Waiver of Punitive & Class Action Claims: You agree to claim only compensatory damages and waive rights to punitive damages. All claims must be brought in an individual capacity, and you expressly waive any right to participate in class actions or representative proceedings.
   

• Severability & Entire Agreement: If any provision is deemed invalid or unenforceable, it will be replaced by a valid provision matching the original intent, and the remainder of the terms shall remain in effect. These Terms constitute the entire agreement between you and Journeys by Jacqy.​​
